Arrest Order kay Chief Justice Sereno Walang Legal Basis Sabi ng Isang Legal Expert

Ipinahayag ng legal expert na si Atty. Romulo Macalintal na walang legal basis at walang constitutional

basis kung magpapalabas ng arrest order ang House of Representatives kay Chief Justice Maria Lourdes Sereno.

Kung ang House Committee on Justice ang ihahalintulad ang procedings nito sa preliminary investigation mas lalong walang karapatan na mag serve ng warrant kung ayaw dumalo ni Sereno ng hearing.

Kung hindi dadalo si Sereno sa hearing ibig sabihin nito ay waiver ng kanyang karapatan to “controvert the evidence presented against her.”

Ayon kay Macalintal sa rules on preliminary investigation ” If the respondent upon being subpoenaed, does not submit his/her counter affidavit, the investigating officer shall resolve the complaint based on the evidence presented by the complainant.”

Samantala sa nagpapatuloy na impeachment proceedings kay CJ Sereno pinayagan na ng Korte Suprema ang mga justices at mga empleyado na inimbitahan ng HR para dumalo sa impeachment proceedings laban kay Sereno at sagutin ang complaint on administrative matters.

May clearance na sila mula sa korte kung gusto nilang mag testify laban sa chief justice.
